1. Introduction and Acceptance
Welcome to Storypie Press. These Terms of Service (“Terms”) govern your access to and use of the Storypie Press platform, website, and services available at storypiepress.com (collectively, the “Service”), operated by Storypie Press LLC, a Texas limited liability company (“Storypie Press,” “we,” “us,” or “our”).
By accessing or using our Service — including creating an account, initiating a book creation, making a purchase, or browsing our website — you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and, for material changes, notify you by email or by a prominent notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
2. Eligibility and Account
2.1 Age Requirement
You must be at least 18 years old to use the Service. The Service is intended for use by adults on behalf of, or as gifts for, children. It is not directed at children under 13. By using the Service, you represent and warrant that you are 18 years of age or older.
2.2 Account Registration
Some features of the Service require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@storypiepress.com if you suspect any unauthorized use of your account.
2.3 One Account Per Person
Each person may maintain only one account. We reserve the right to terminate duplicate accounts.
3. Description of the Service
Storypie Press is an AI-powered platform that enables users to create personalized children’s books. Through a guided creation experience, you provide story inputs — including character details, themes, settings, and narrative direction — and our Service uses artificial intelligence to generate an original story and accompanying illustrations. The resulting book may be delivered as a digital file (PDF) or as a professionally printed hardcover book fulfilled by our print partner.
3.1 The Creation Process
The creation flow collects information you provide about the characters and story you wish to create, including a child’s name, age range, personality, interests, and other story details you choose to share. This information is used solely to generate your book. You are responsible for ensuring that the information you provide is appropriate and accurate.
3.2 Preview Before Purchase
Before completing a purchase, you will be presented with a watermarked preview of your complete generated book. This preview allows you to review the story content, illustrations, and overall presentation before committing to payment. By completing a purchase after reviewing the preview, you confirm that you have reviewed and accept the generated content.
3.3 AI-Generated Content
All story text and illustrations produced by the Service are generated by artificial intelligence. Storypie Press does not employ human authors or illustrators to create the content of individual books. The AI generation process is guided by your inputs and our proprietary prompting system, but the output is probabilistic in nature. We do not guarantee that every generated book will meet your precise expectations, and results may vary.
3.4 Delivery Options
Upon completing your purchase, the Service offers two delivery formats:
- Digital Only: A digital reader available via a dedicated web link. A high-resolution PDF downloaded to your device is also available.
- Print + Digital: A professionally printed hardcover book fulfilled by our third-party print partner and shipped to the address you provide, plus a digital PDF copy downloadable to your device. Print production and shipping times are estimates only; see Section 8 for details.
4. AI-Generated Content — Important Disclosures
4.1 Nature of AI Output
The stories and illustrations in every Storypie Press book are generated by artificial intelligence. While we design our systems to produce age-appropriate, high-quality, and coherent content, AI generation is an imperfect process. You acknowledge and accept that:
- Generated stories may occasionally contain grammatical imperfections, awkward phrasing, or narrative inconsistencies.
- Illustrations may occasionally contain visual artifacts, anatomical imperfections, or inconsistencies in character appearance across pages.
- Colors, line quality, and artistic style in printed books may differ from what appears on screen due to differences between digital display and print reproduction.
- Character appearance may vary between pages despite our character consistency systems.
4.2 Your Responsibility to Review
We strongly encourage you to review your complete watermarked preview before completing your purchase. Once a print order has been submitted to our fulfillment partner, we cannot modify the content. The preview-before-purchase design of our Service is specifically intended to give you the opportunity to identify any issues before committing.
4.3 Content Accuracy
Storypie Press does not guarantee the factual accuracy of AI-generated story content. If you include specific real-world details — places, events, facts — the AI may handle them imperfectly. Review your preview carefully for accuracy.
4.4 AI Safety Filters
Our Service relies on the content safety systems of the AI-model providers used in the service. These are designed to prevent the generation of harmful, inappropriate, or offensive content. These systems may occasionally affect generation in ways that alter your requested content. We do not override these safety systems under any circumstances.
5. Intellectual Property
5.1 Storypie Press Platform
The Storypie Press platform, website, software, design, wizard experience, prompting systems, trademarks, logos, and all associated technology are the exclusive property of Storypie Press LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, reverse engineer, or create derivative works of any part of the platform without our express written permission.
5.2 Your Generated Books
When you purchase a book through the Service, Storypie Press grants you a personal, non-exclusive, non-transferable license to use, display, share, and print your purchased book for personal, non-commercial purposes. This includes sharing digital copies with family and friends and printing additional personal copies.
5.3 AI-Generated Content and Copyright
You acknowledge that AI-generated content — including both story text and illustrations — may have limited or no copyright protection under applicable law. The U.S. Copyright Office has indicated that content generated solely by AI without sufficient human authorship may not be eligible for copyright registration. Storypie Press makes no representations or warranties regarding the copyright status of any generated content.
Storypie Press retains all rights in and to the platform, and prompting system used to generate your book. The specific story and illustrations generated for your book are licensed to you as described above.
5.4 Commercial Use
Books created through the Service are licensed for personal and gift use only. Commercial use — including resale, publishing, distribution for profit, or use in commercial advertising — requires a separate written agreement with Storypie Press. Contact us at hello@storypiepress.com to discuss commercial licensing.
5.5 Your Input Content
You retain ownership of the story inputs, character descriptions, and other content you provide through the wizard. By submitting content to the Service, you grant Storypie Press a limited license to use that content solely for the purpose of generating your book and operating the Service. We do not use your story inputs to train AI models without your explicit consent.
6. Prohibited Uses
You agree not to use the Service to:
- Create content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Generate content that depicts, sexualizes, or could harm minors in any way
- Attempt to generate content featuring real, named individuals without their consent
- Attempt to circumvent, disable, or interfere with our content safety systems
- Use automated tools, bots, or scripts to access or interact with the Service without authorization
- Attempt to reverse engineer, decompile, or extract AI models, or prompting systems
- Resell, sublicense, or commercially distribute books created through the Service without written authorization
- Use the Service in any way that violates applicable law, regulation, or these Terms
- Misrepresent your identity or provide false information during the creation process or at checkout
We reserve the right to suspend or terminate accounts that violate these prohibitions, without refund, and to report unlawful activity to appropriate authorities.
7. Children’s Privacy and COPPA
7.1 Service Directed at Adults
The Storypie Press Service is directed at adults (18+) and is not intended for direct use by children under 13. We do not knowingly collect personal information directly from children under 13. All accounts must be created and managed by adults.
7.2 Information About Children Provided by Adults
When you create a personalized book, you may choose to provide information about a child — such as their name, age range, and interests — to personalize the story. This information is provided by you, an adult, on behalf of the child. We use this information solely to generate the book you have requested and to operate the Service.
We do not use children’s personal information for advertising, profiling, or any purpose other than book generation and fulfillment. We do not sell children’s personal information.
7.3 Photo Upload
The Storypie Press Service does not require or request the upload of photographs of children. Character appearances are generated based on your written descriptions only.
7.4 Data Retention
Story inputs and generated content are retained as described in our Privacy Policy. If you wish to have your data deleted, contact us at hello@storypiepress.com.
8. Pricing, Payment, and Refund Policy
8.1 Pricing
Current prices for our products are displayed on our website at the time of purchase. Prices are in US dollars and are subject to change. Sales tax or VAT may be applied where required by law.
8.2 Payment Processing
Payments are processed by Stripe, a third-party payment processor. By making a purchase, you agree to Stripe’s terms of service. Storypie Press does not store your full payment card information. We accept major credit and debit cards as displayed at checkout.
8.3 Refund Policy — Digital Books
Digital books (PDF delivery): Because digital books are delivered immediately upon purchase and you have the opportunity to review a complete watermarked preview before purchasing, all digital sales are final. We do not offer refunds on digital purchases except where required by applicable law, or in the case of a technical failure that prevents delivery of your file. If you experience a technical issue with your digital delivery, contact us within 7 days at hello@storypiepress.com and we will resolve the issue.
8.4 Refund Policy — Printed Books
Printed books: Because each printed book is a custom-manufactured item produced specifically for your order, we do not accept returns or offer refunds once a print order has been submitted to our fulfillment partner. You are responsible for reviewing your watermarked preview carefully before completing your purchase.
However, we will replace or refund a printed book at no charge if:
- The book arrives damaged due to manufacturing defects or shipping damage — report within 14 days of delivery with photographic evidence
- The book does not arrive within 30 days of your order confirmation — contact us and we will investigate with our fulfillment partner
- The printed book differs materially from the preview you approved at purchase
To request a replacement or refund under these conditions, contact hello@storypiepress.com within 14 days of the delivery date (or 30 days of order date if the book has not arrived).
8.5 Print Fulfillment and Shipping
Printed books are manufactured and fulfilled by Lulu Direct, a third-party print-on-demand service. Storypie Press does not warehouse or ship physical books directly. Estimated production and shipping times are provided at checkout and are estimates only — we cannot guarantee delivery dates and are not responsible for delays caused by our fulfillment partner or shipping carriers.
Shipping rates are calculated at checkout based on your delivery address. We currently ship to addresses within the United States. International shipping availability may vary.
8.6 Order Cancellation
You may cancel a print order only before it has been submitted to our fulfillment partner. Once production has begun, cancellation is not possible. Digital orders cannot be cancelled once the book has been finalized. If you believe you placed an order in error, contact us immediately at hello@storypiepress.com and we will do our best to assist before production begins.
9. Disclaimers of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Storypie Press does not warrant that:
- The Service will be uninterrupted, error-free, or available at any particular time
- Generated content will be accurate, complete, or free from errors or artifacts
- The Service will meet your specific creative expectations or requirements
- Any defects in the Service will be corrected
- Printed books will exactly reproduce the appearance of digital previews
AI-generated content is inherently variable and probabilistic. While we design our systems to produce high-quality output, we make no guarantee that any particular generation will achieve the result you envision. The preview-before-purchase feature is your primary tool for evaluating quality before committing to payment.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STORYPIE PRESS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Storypie Press LLC and its members, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) content you provide through the Service; or (d) your violation of any rights of another party.
12. Third-Party Services
The Service integrates with third-party services including payment processing (Stripe) and print fulfillment (Lulu Direct). Your use of these services is subject to their respective terms of service and privacy policies. Storypie Press is not responsible for the practices, availability, or terms of any third-party service.
Our website may contain links to third-party websites. These links are provided for convenience only. We do not endorse and are not responsible for the content or practices of any linked third-party website.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
13.2 Informal Resolution
Before filing any formal legal claim, you agree to contact us at hello@storypiepress.com and attempt to resolve the dispute informally. We will attempt to resolve most concerns within 30 days.
13.3 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if they qualify. The arbitration will be conducted in Austin, Texas, or remotely if mutually agreed.
13.4 Class Action Waiver
YOU AND STORYPIE PRESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13.5 Exceptions
Nothing in this section prevents either party from seeking injunctive or other equitable relief for intellectual property infringement or misuse.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storypie Press regarding the Service and supersede any prior agreements.
14.2 Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
14.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
14.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
14.5 Force Majeure
Storypie Press will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, pandemic, power outages, or failures of third-party services.
15. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days’ notice by email or prominent notice on the Service before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
